| metadata.dc.description.resumo: | Este artigo tem por objetivo analisar os dispositivos legais relativos a proteção de vítimas e testemunhas. Trata-se, portanto, de uma investigação enquadrada na vertente teórico- metodológica jurídico-dogmática, utilizando a abordagem qualitativa e o método indutivo. Metodologicamente, este trabalho se utiliza da pesquisa bibliográfica e documental. O artigo é dividido em três partes: inicialmente, cabe discorrer sobre a o papel da vítima e testemunhas, com ênfase nos dispositivos legislativos, e a Lei 9.807 e o Programa Federal de Assistência a Vítimas e Testemunhas Ameaçadas; posteriormente é discutido os dispositivos relacionados a proteção de réus colaboradores; e por fim,se verifica a necessidade de mecanismos de proteção a vítimas e testemunhas no contexto do Estado Democrático de Direito. O argumento dessa produção é de uma evolução do papel da vítima no processo penal possibilitado pelas garantias do Estado Democrático de Direito. |
| Abstract: | This article aims to analyze the legal provisions regarding the protection of victims and witnesses. It is, therefore, an investigation framed within the theoretical-methodological legal- dogmatic strand, using the qualitative approach and the inductive method. Methodologically, this paper makes use of bibliographic and documentary research. The article is divided into three parts: initially, it discusses the role of victims and witnesses, with emphasis on the legislative provisions, Law 9.807 and the Federal Program of Assistance to Threatened Victims and Witnesses; subsequently, it discusses the provisions related to the protection of collaborator defendants;and finally, it verifies the need for protection mechanisms for victims and witnesses in the context of the Democratic State of Law. The argument for this production is the evolution of the role of the victim in the criminal process made possible by the guarantees of the democratic rule of law. |
