Análise da atuação da Defensoria Pública da União na garantia dos direitos sociais dos indígenas refugiados da etnia Warao no Município de Palmas, Tocantins

Abstract

The current article had seeked to study how the forced immigration of Venezuelan Warao indigenous people has questioned the guarantee of the human rights of refugees in Palmas, Tocantins, since the proposal of the Public Civil Suit, because they were in a homeless situation, begging for "handouts” at traffic lights. For this purpose, the legal relationship of the matter in question, as well as the social and humanitarian reflexes, from the national and international legal systems were initially analyzed. Normative instruments, jurisprudential understandings of the Higher Courts, internal administrative and judicial acts, local press reports, social and ethnological studies on the indigenous theme, and specialized international literature were consulted. The final considerations suggest that this is a delicate subject, by its very legal nature, and that the Office of the Federal Public Defender did an efficient work in proposing the Public Civil Suit, fulfilling absolutely all the necessary precepts and foundations.
