| metadata.dc.description.resumo: | O presente trabalho tem por objetivo analisar criticamente os Planos Individuais de Atendimentos (PIAs) dos adolescentes em cumprimento de Liberdade Assistida (LA), entendendo como se dá esse processo e se o PIA é configurado como um instrumento metodológico para assegurar um atendimento individualizado. O estudo se qualifica como uma pesquisa histórica, documental e qualitativa, possibilitando novas reflexões sobre o tema abordado. Nossas fontes de dados foram os Planos Individuais de Atendimento e os relatórios técnicos dos adolescentes que cumprem medida socioeducativa de Liberdade Assistida no município de Palmas-Tocantins. Analisar os relatórios técnicos foi necessário, pois neles constam como foi realizada a execução do PIA. Em nosso estudo criamos categorias de análise, a saber: o sujeito por trás do seu delito; singularidade ou reprodução de desproteção social no PIA? e a imaterialidade da execução do PIA e do trabalho educativo. Os dados foram analisados sob uma perspectiva crítica, ou seja, reconhecendo que a sociedade é marcada e atravessada por uma série de fenômenos e acontecimentos sociais e históricos, que interferem na produção da subjetividade e da violência. A partir do desenvolvimento da pesquisa constatamos que as relações sociais de exploração e de violência estrutural seguem como parte do contexto em que os adolescentes autores de ato infracional estão inseridos. Nesse sentido, verificamos que são adolescentes da camada popular que frequentemente cumprem medidas socioeducativas. Ademais, constatamos que os PIAS analisados não carregam as especificidades dos casos retratados, reproduzindo a lógica de centrar a responsabilidade do novo projeto de vida no adolescente e família, sem que o Estado dê condições concretas para tanto, reproduzindo, em certa medida, a velha lógica de assistência à infância anterior ao ECA. Por fim, entendemos que as leis sairão do campo da ideia na medida em que avançarmos na garantia de direitos sociais, por isso o PIA, por si só, não será capaz de enfrentar a violência, que é uma das formas de expressão da questão social. |
| Abstract: | This paper aims to critically analyze the Individual Plans of Attendance (PIAs) of adolescents serving Assisted Liberty (AL), understanding how this process occurs and if the PIA is configured as a methodological tool to ensure individualized care. The study qualifies as a historical, documental and qualitative research, enabling new reflections on the theme addressed. Our data sources were the Individual Care Plans and the technical reports of the adolescents who serve an Assisted Freedom social-educational measure in the municipality of Palmas-Tocantins. Analyzing the technical reports was necessary because they show how the execution of the IAP was carried out. In our study we created categories of analysis, namely: the subject behind his or her crime; singularity or reproduction of social unprotection in the IAP? and the immateriality of the execution of the IAP and the educational work. The data were analyzed from a critical perspective, that is, recognizing that society is marked and crossed by a series of phenomena and social and historical events that interfere in the production of subjectivity and violence. From the development of this research we found that the social relations of exploitation and structural violence continue as part of the context in which adolescents who commit infractions are inserted. In this sense, we verified that these adolescents are from the lower social strata of the population who frequently serve socioeducational measures. Furthermore, we found that the PIAS analyzed do not bear the specificities of the cases portrayed, reproducing the logic of focusing the responsibility of the new life project on the adolescent and the family, without the State providing concrete conditions for this, reproducing, to some extent, the old logic of childhood assistance prior to the ECA. Finally, we understand that the laws will leave the field of ideas as we advance in the guarantee of social rights, so the IAP alone will not be able to face violence, which is one of the forms of expression of the social issue. |
