metadata.dc.description.resumo: Da belíssima normativa de alicerce do Trabalho decente aos princípios constitucionais de ressocialização penal, existe um vácuo que obsta a transformação da vida de mais de quarenta e duas mil mulheres que foram condenadas nas prisões brasileiras. Diante do capitalismo excludente e opressor para a discussão do resgate social da reeducandas, as ações governamentais necessitam voltar seu olhar ao labor probo dessa mulher, sem desprezar sua condição materna e o seu sustento digno familiar, haja vista lhes serem inerentes. A busca dessa efetividade passa por paradigmas normativos e ações que interliguem essa mulher a uma real chance transformadora de vida. Esse é o viés dos passos para os quais o direito penal que deve ser conduzido. Sua potente mão, não pode se resumir em justiça para cidadãos desvalidos de da proteção Estatal. As garantias constitucionais são conferidas a todos os brasileiros, o direito ao trabalho decente também. Frente a essa nova sistemática de pensamento cidadão, já é hora de se consubstanciarem novas políticas voltadas para o trabalho decente dessa população carcerária, a fim de que se harmonizem o caráter punitivo da pena diante aos postulados de um Estado Democrático de direito sólido, humano e solidário. O histórico da evolução do trabalho como castigo aplicado ao direito segregatório da condenada penal é proposta sob à ressocialização do trabalho decente. Alicerçado nos pilares constitucionais de cidadania e humanização encontrouse na estrutura intrínseca do capital o seu maior obstáculo. Para explanar o assunto buscou-se conhecer o perfil dessa mulher em cárcere, às políticas públicas estatais e judiciárias voltadas ao seu labor, principalmente quanto à oferta de vagas de trabalho, à saúde e segurança do trabalho dessa mulher, intimamente ligados à maternidade e acompanhamento de seus filhos dependentes, bem como o panorama remuneratório, como fator principal ao mínimo existencial para o trabalho decente. Todos os fatores sob o enfoque da novíssima política normativa nacional de trabalho no âmbito do sistema prisional – PNAT depara-se com as interpretações quanti-qualitativos dos Informativos penitenciários do Departamento Nacional, que quando possíveis de serem feitas, relatam que a norma não será, por si só, suficiente ao resgate da mulher apenada.
Abstract: From the beautiful normative of the foundation of Decent Work to the constitutional principles of criminal resocialization, there is a vacuum that prevents the transformation of the lives of more than forty-two thousand women who have been convicted in Brazilian prisons. In the face of exclusionary and oppressive capitalism for the discussion of the social redemption of reeducation, governmental actions need to to look at the labor of this woman, without neglecting her maternal condition and her decent family support, since they are inherent in them. The search for this effectiveness goes through normative paradigms and actions that interlace this woman into a real lifetransforming chance. This is the bias of the steps for which criminal law is to be conducted. His powerful hand can not be summed up in justice for underprivileged citizens of state protection. The constitutional guarantees are conferred on all Brazilians, the right to decent work as well. Faced with this new system of citizen thinking, it is time to consolidate new policies aimed at the decent work of this prison population, in order to harmonize the punitive character of punishment in the face of the postulates of a solid, human and democratic right state. supportive. The history of the evolution of work as punishment applied to the segregatory right of the convicted criminal is proposed under the re-socialization of decent work. Based on the constitutional pillars of citizenship and humanization, the main obstacle was found in the intrinsic structure of capital. In order to explain the subject, it was sought to know the profile of this woman in jail, the state public and judicial policies focused on her work, mainly regarding the offer of job vacancies, the health and safety of the woman's work, closely related to maternity and follow-up of their dependent children, as well as the remuneration scenario, as the main factor to the existential minimum for decent work. All factors under the focus of the new national normative labor policy in the prisons system - PNAT are confronted with the quantitative-qualitative interpretations of the National Department's, which, when possible, will alone be sufficient for the ransom of the grieving woman.
