| metadata.dc.description.resumo: | A presente dissertação traz reflexões sobre os modos de tratamento direcionado aos réus, nos momentos de audiências ocorridas no Fórum da cidade do Rio de Janeiro, estado do Rio de Janeiro (RJ). O objetivo geral foi analisar como se apresenta a questão do tratamento humanitário no sistema judiciário brasileiro, a partir do documentário “Justiça”, da cineasta Maria Augusta Ramos. O problema do trabalho foi como se apresenta a questão do tratamento humanitário no sistema judiciário até o sistema prisional, na referida obra. Para tanto, os objetivos específicos foram: descrever de que forma o documentário mostra o sistema judiciário e o sistema prisional; verificar a atuação profissional dos magistrados nos momentos de audiências, se de fato tem acontecido de forma humanitária e sem abuso de poder; identificar quais os aspectos apresentados que apontam a falta de tratamento humanitário nas audiências mostradas no documentário e a possibilidade de avanço na comunicação mais sensibilizada para os réus. O método da pesquisa foi a análise de conteúdo, por meio da observação da obra e, por isso, optou-se pelo caráter qualitativo, descritivo e bibliográfico. Portanto, preferiu-se pelo método dialético, porque tem uma abordagem central como o uso da discussão e da argumentação acerca dos fatos e da análise do objeto. Além disso, permitiu-se adentrar na realidade para compreendê-la, realizando-se conexão com os estudos e teorias já produzidas em torno da temática estudada. A pesquisa trouxe elementos importantes para reflexão direta na sociedade, uma vez que as audiências acontecem de forma burocratizada, institucionalizada e, muitas vezes, não humanizada. |
| Abstract: | This master brings reflections on the treatment modes directed at defendants, during hearings that took place in the Forum of Rio de Janeiro city, in Rio de Janeiro state (RJ). The general objective was to analyze how the issue of humanitarian treatment in the Brazilian judicial system is presented, based on the documentary entitled Justiça (Justice), by filmmaker Maria Augusta Ramos. The research problem was how the issue of humanitarian treatment in the judiciary system up to the prison system is presented in that work. To this end, the specific objectives were: to describe how the documentary shows the justice system and the prison system; to verify the professional performance of judges during hearings, if in fact it has been carried out in a humanitarian manner as well as without abuse of power; to identify which aspects presented point to the lack of humanitarian treatment in the hearings shown in the documentary and the possibility of advancing in more sensitive communication for the defendants. The research method was content analysis, through observation of the work and, therefore, we opted for a qualitative, descriptive and bibliographic research. So, we chose the dialectical method, because it has a central approach such as the use of discussion and argumentation about the facts and the analysis of the object. In addition, it was allowed to enter reality to understand it, making a connection with the studies and theories already produced about the subject studied. The research brought important elements for direct reflection in society, since hearings take place in a bureaucratic, institutionalized and, often, non-humanized way |
